Terms And Conditions For Hiring The Vehicle
- Darshan Tours and Travels is a company incorporated in India and
having its
registered
office presently at
Plot no:- 550, Madhusudan Nagar, Nicco Park Road, Bhubaneswar:- 751012.
- These terms and conditions govern all the regulations, rights, terms and conditions
between Darshan Tours and Travels and the hirer. If the hirer is
not the rider of
the
vehicle, it is the hirer’s obligation to ensure that the rider of the bike shall
follow
the terms and conditions strictly. Any failure from the rider to follow the terms
and
conditions of this agreement shall make the hirer liable. The rider/hirer will be
rejected (blacklisted) by Darshan Tours and Travels if the hirer
disobeys our terms
and
conditions,
traffic norms, or commits other offences which are strictly prohibited.
- By accepting the terms and conditions, you will be legally bound to follow all the
below-mentioned terms and conditions during your trip. Without your acceptance of
these
terms and conditions, Darshan Tours and Travels will not be able to provide any
motorbike to the hirer.
If you disagree with any of the terms of this agreement, please refrain from hiring
the
bike.
User Account, Booking And Payment
- Darshan Tours and Travels provides two-wheeler motorbikes on rent.
To avail of these
services, the hirer must carefully fill out the online form,
which includes uploading valid documents such as identity proof, address proof,
contact
details, and a valid driving license on our website
(https://www.darshanholidaysindia.com/).
- The hirer must also select the desired date, time, and motorbike through the
website.
- All applicable tariffs and rental rates can be viewed on our website.
Hirer’s Undertaking
- It is agreed that the hirer is solely responsible for all risks associated with the
motorbike during its custody.
- If the vehicle is used in a manner that is not permitted under law or is in
violation of
any legal provisions,
the hirer shall assume full liability and
shall indemnify Darshan Tours and Travels from all statutory and other liabilities
arising therefrom.
The Hirer Shall Abide By The Following Terms And Conditions
- The motorbike shall be used in full compliance with the Motor Vehicles Act, all
applicable rules, and other relevant laws.
- The rider of the motorbike must possess a valid driving license and Aadhaar card,
and
copies of these documents must be
provided to Darshan Tours and Travels before the commencement of the rental period.
Use Of Vehicle And Conduct
- A security deposit of ₹1,000–₹2,000 for scooters and bikes up to 400cc,
and
₹2,000–₹5,000 for bikes above 400cc, will be charged. The deposit is
fully
refundable
after the return and inspection of the motorbike. However, if there is any deviation
from the terms of this agreement, the security deposit may be withheld by Darshan
Tours
and Travels.
- Penalty for late return: If the hirer returns the motorbike beyond the time
specified in
the booking form, a penalty of ₹300 for scooters and ₹500 for bikes
will be charged,
in
addition to double the hourly fee for the extra usage period.
- If the hirer wishes to extend the ride, he/she must do so through our online
platform (https://www.darshanholidaysindia.com/) at least one hour before the scheduled return time to avoid a penalty.
Extensions
will
not be permitted if another booking has already been confirmed for that vehicle.
- The rider must follow all safety precautions, including the mandatory use of a
helmet as
required under the Motor Vehicles Act. If the helmet is found damaged or lost upon
return, the hirer will be charged the full replacement cost. The hirer must be aware
of
all rules and regulations under the Motor Vehicles Act. If not, he/she is advised
not to
hire the motorbike.
- Riding the motorbike with more than one person (other than the rider) is strictly
prohibited.
- Riding or using the motorbike under the influence of alcohol or drugs is strictly
prohibited.
- While riding, the use of electronic gadgets such as radios, music players, or mobile
phones by the rider or pillion is strictly prohibited.
- Using the motorbike to carry unlawful, hazardous, or prohibited materials is
strictly
prohibited.
- The motorbike must be operated only with the prescribed fuel type for the selected
model.
- The motorbike may be used only within the area specified in the booking form. If the
hirer/rider intends to go beyond the approved area, prior written intimation must be
given to Darshan Tours and Travels.
- The rider must inform Darshan Tours and Travels in advance if intending to travel to
other districts or states. The rider must obtain all necessary permits and approvals
at
state borders and pay the required permit fees. Darshan Tours and Travels will not
be
responsible for any damage, loss, or legal issues arising from failure to obtain
such
permits.
- In case the motorbike is stolen during the trip, the hirer must immediately inform
the
local authorities and Darshan Tours and Travels without delay. An FIR must be filed
with
the local police station. Darshan Tours and Travels will provide all necessary
assistance, and the hirer must cooperate fully to complete the required formalities.
Violation Of Law
- The rider shall strictly adhere to speed limits, traffic rules, and all
directions issued by the police or other law enforcement authorities. In the
event of any violation—such as over-speeding, signal jumping, carrying more than one
pillion, riding without a helmet, or illegal parking—the hirer/rider shall bear full
responsibility for payment of all fines or penalties.
- If any case or fine is registered by the authorities against Darshan
Tours
and Travels, being the owner or permit holder of the motorbike, the hirer
shall
indemnify and compensate Darshan Tours and Travels for all such costs, fines, and
legal
expenses incurred.
- 3. If the rider exceeds the speed limit prescribed under traffic rules or any
applicable
law, Darshan Tours and Travels shall not be responsible for any loss,
injury,
or damage to the motorbike, rider, or third parties. The hirer/rider
shall be solely liable for all such losses or damages occurring during the period of
custody.
- Darshan Tours and Travels reserves the right to impose a fine of
₹200
for each instance of over-speeding, as recorded in the hirer’s booking details.
Repeated
violations may lead to blacklisting of the rider from future rentals.
- The motorbike shall not be used for transporting goods or carrying any
luggage
beyond what is legally permitted under the Motor Vehicles Act or related
regulations.
- The motorbike must be returned on the date and time specified in the
booking
form, in good condition, without any damage or delay.
- If the hirer/rider travels to other districts or states not mentioned in
the
booking form and fails to inform Darshan Tours and Travels in advance, he/she
shall be solely responsible for any legal, financial, or operational consequences
arising from such unauthorized travel.
Accident And Breakdown

If the motorbike is stolen during the trip, the hirer must immediately inform both
the
local authorities and
Darshan Tours and Travels without any delay. An FIR must be filed
with
the local police station.
Darshan Tours and Travels will provide all necessary assistance,
and
the hirer shall fully cooperate
in completing the required formalities.

In the event of a breakdown, the rider/hirer must immediately inform
Darshan Tours and Travels, specifying the location and nature of
the
defect. The company will send a mechanic
or provide guidance for repair or rectification to resume the ride as soon as
possible.
However,
Darshan Tours and Travels does not guarantee a specific repair
timeline, as it depends on factors such as
vehicle location, nature of the defect, mechanic availability, and spare parts. The
hirer acknowledges that mechanical
failures are unpredictable and accepts that such risks are inherent in the vehicle
rental.

In case of loss or damage to the motorbike, Darshan Tours and
Travels
may charge an amount equivalent to
the cost of the vehicle, repair charges not covered by insurance, and any loss of
revenue suffered due to downtime.

In the event of an accident:
- For motorbikes/scooters above 180cc, the hirer shall pay between ₹2,500 –
₹25,000.
- For motorbikes/scooters up to 180cc, the hirer shall pay between ₹1,500 –
₹15,000.
The hirer must also submit a written statement detailing the incident, including the
date, time, location,
and any third-party/property damage or police report arising from the accident.
Upon return of the motorbike, the hirer shall settle dues through cash, online
transfer,
or a crossed cheque
in the name of Darshan Tours and Travels to cover any amounts not
approved by the insurance company.

All accidents, damages, or legal notices issued by the police or court in relation
to
the vehicle while under the
hirer’s custody must be immediately reported in writing to Darshan Tours and
Travels. Any misstatement
or concealment of information will be treated as an offence.
-
If any authority imposes a fine or penalty related to the rider’s use of the
motorbike,
the hirer shall be fully
responsible for paying the penalty amount and any associated legal costs to
Darshan Tours and Travels.
-
The hirer must inspect and verify the motorbike’s condition before taking delivery.
Darshan Tours and Travels shall not be held responsible for any
loss of
life, injury, or property
damage arising from the condition of the vehicle once handed over.
-
The hirer/rider shall not use the motorbike for speed contests, races, competitions,
stunts, or adventure activities
that may endanger life or property.
-
The hirer/rider shall not operate the motorbike in any way that causes excessive
wear
and tear.
Darshan Tours and Travels reserves the right to penalize or
blacklist
any hirer found responsible
for such misuse.

The hirer is not permitted to perform repairs, attach external fixtures, or replace
any
part of the motorbike
without prior authorization from Darshan Tours and Travels.
-
The hirer shall compensate the company for all damages caused to the motorbike. In
case
of an accident, the hirer
shall bear the towing costs, third-party damages, and any other expenses not covered
by
insurance.
-
If the accident or damage occurs due to violation of traffic or legal rules, the
hirer
shall bear the entire cost
of repairs, third-party damages, and any compensation payable to victims.
-
Darshan Tours and Travels shall not be responsible for any damage,
loss, theft, or personal belongings
of the hirer that are not covered by insurance, including those arising from
mechanical
failure, accidents, or negligence.
The hirer/rider shall be solely responsible for such losses and must bear all
recovery
costs.
Cancellation Policy
If you cancel the booking, the refund will be processed within 5–7 working
days
as per the following schedule:
In case of Advance Booking:
- If you cancel 24 hours before the scheduled date and time –
100% of the paid amount will be refunded.
- If you cancel 6 hours before the scheduled date and time –
50% of the paid amount will be refunded.
- If you cancel less than or equal to 6 hours before the scheduled
date
and
time – No refund will be given.
In case of Same Day Booking:
- If you cancel 2 hours before the scheduled date and time –
50% of the paid amount will be refunded.
- If you cancel less than or equal to 2 hours before the scheduled
time –
No refund will be given.
- If we cancel the booking due to breakdown, non-availability of the bike, or any
other
reason, we will provide a 100% refund of the rental amount
received.
- If a confirmed motorbike is unavailable due to reasons such as breakdown,
maintenance
work,
accident, or natural calamities (floods, fire, earthquake, terrorism, strikes, or
government
restrictions), we will inform you accordingly as these are beyond our control.
You will be entitled to cancel the booking and receive a refund if:
- We reserve the sole right to cancel your booking.
- If you don’t pick up the motorbike on time, your booking will remain valid for
2
hours from the scheduled time and will automatically be cancelled
thereafter.
- Your booking is cancelled due to lack of necessary information.
- The booked motorbike is unavailable.
- Unavailability occurs due to conditions beyond our control (natural calamities,
floods,
fire, earthquakes, acts of terrorism, war, strikes, or government restrictions).
- Motorbikes become unavailable or break down due to accidents — in such cases, a
full
refund will be issued.

For non-Indian

The Passport will be retained by Darshan Tours and
Travels
during the rental period
and returned once the hired vehicle is returned.

250cc
and at least 18 years of age to ride motorbikes below
250cc.

Pick Up And Return Of Vehicle

The hirer must pick up the motorbike from the location specified in their booking
order
and
return it in the same working condition at the same location and time.

The hirer is strongly advised to inspect the motorbike (for noticeable mechanical or
visual
defects) before taking it.
The hirer shall bear all costs of replacement for any damage to the motorbike, loss
of
tools, or spare parts kept with it.
Any damage or issue that occurs during the ride must be reported to Darshan
Tours
and Travels when returning the vehicle.

The hirer must inform Darshan Tours and Travels immediately if any
abnormality in the motorbike is noticed during the ride.

A picture of the hirer with the hired motorbike will be taken for official use at
the
time
of vehicle pick-up.
Privacy
Darshan Tours and Travels respects the privacy of the hirer/rider to the
fullest extent possible.
However, the hirer agrees that the following personal information may be collected by
Darshan Tours and Travels:
- Name
- Address
- Contact numbers
- Email ID
- Gender
- Age
- Driving license details
- Aadhar card (identity proof and address proof)
The collected information may be used for the following purposes:

To share with relevant government agencies if required to furnish any data.
-
To provide support in case of an accident or hospitalization by coordinating
with local authorities, police, mechanics, hospitals, relatives, or friends of the
hirer/rider as needed.
-
To use for promotional purposes, including offering benefits, discounts, or updates
to
customers
by Darshan Tours and Travels.
-
The hirer must cooperate with the representative of Darshan Tours and
Travels
in taking a photo of the vehicle along with the hirer for safety and record
purposes.
Undertaking And Assurance
-
The hirer hereby undertakes and acknowledges that any claim, damage, or loss that
may
arise
during the custody of the vehicle will be his/her sole responsibility. If any such
claims
arise against the owner of the vehicle, they shall be defended at the cost of the
hirer.
Any penalty, fine, damages, or compensation imposed by a court, police, or other
authority
in relation to the use of the vehicle while under the hirer’s custody shall be borne
entirely
by the hirer. This includes claims from third parties, passengers, or any activities
conducted
by the hirer during the rental period.

The hirer shall, at his/her own expense, defend, indemnify, and hold
Darshan Tours and Travels and its officers, directors, agents,
employees,
and consultants harmless from any damages, liabilities, claims, losses, costs,
demands,
suits, actions, or reasonable expenses (including legal fees and settlement costs)
arising
out of or related to third-party claims resulting from the hirer’s use or misuse of
the
vehicle.

The hirer is legally responsible for all damages and losses to the motorbike and
agrees
to indemnify Darshan Tours and Travels for all liabilities incurred
while the vehicle is under his/her custody.
-
The hirer assumes full responsibility for any damage, theft, or loss of property
involving
the vehicle during the rental period. All expenses incurred for repair or
replacement
due to such damage, theft, or loss shall be borne solely by the hirer.
-
The rights granted to the hirer under this agreement are non-transferable and
non-assignable,
in whole or in part. If the hirer allows another rider to operate the vehicle,
the details and a copy of that rider’s valid driving license must be submitted
in advance to Darshan Tours and Travels for approval.
-
All motorbikes are covered under insurance for the risks specified in the insurance
policy
taken by Darshan Tours and Travels.
Arbitration/ Dispute Resolution
- In the event of any dispute or difference arising between
Darshan Tours and Travels and the hirer with regard to the rights
and obligations
under this agreement, or any monetary claim, or the interpretation and effect of any
terms and
conditions of this agreement, the same shall be referred to arbitration.
- Such arbitration shall be conducted in accordance with the provisions of the
Indian Arbitration and Conciliation Act, 1996, as amended from time
to time.
The venue for such arbitration shall be Bhubaneswar, Odisha, India.
Governing Law & Jurisdiction
These terms and conditions and any disputes or claims arising out of or in connection with
its
subject matter are governed by and construed in accordance with the laws of India and the
Courts
of Bhubaneswar shall be the competent court of jurisdiction.
Complete Agreement
-
This Agreement constitutes the complete and final understanding between
Darshan Tours and Travels and the hirer regarding the subject
matter herein
and supersedes all prior agreements or understandings, whether written or oral,
relating to the same subject matter.

No modification or amendment to this Agreement shall be valid unless made in writing
and duly signed by both parties.

The Hirer read and understood the above terms and conditions and Agree to obey by
it.
